Photofantasm Soundgarden Promotion Giveaway
Official Rules:
1. Eligible:
The Photofantasm Soundgarden Promotion Giveaway (or "Sweepstakes") is offered by Spoondog Entertainment Group, LLC to persons who are (a) legal residents of one (1) of the fifty (50) United States or District of Columbia; and (b) at least 18 years of age or older at the date of entry in this Giveaway. Employees and directors, and their immediate family members, of the Giveaway Entities, and their parents, affiliated and subsidiary companies, advertising and promotion agencies and legal and financial advisors are not eligible to participate in this Giveaway. For purpose of the foregoing, "immediate family" means parents, spouses, children, siblings or any members of the same households of such employees and directors. This Giveaway is void outside of the 50 U.S., in Puerto Rico, in all U.S. territories and possessions, and where prohibited by law. No purchase necessary.
2. Giveaway Timeframe:
The Giveaway entry period begins June 30, 2015 and ends at 12:00pm EST on July 31, 2015. (A new image/hashtag will be posted each Monday until giveaway ends.) Spoondog Entertainment Group, LLC may have multiple Giveaways or Promotions running simultaneously with our without partners at Spoondog Entertainment Group, LLC sole discretion, each with an individual begin and end time, which will be shown on the Giveaway or Promotions separate page.
3. Participation:
You will automatically become a Participant and be entered into the Giveaway when you share Spoondog Entertainment Group, LLC image of Photofantasm Soundgarden by a PUBLIC Retweet, Regram or RePost including the correlating #hashtag for that week on Twitter, Instagram or Facebook. As conditions of entry into the Giveaway, each Participant warrants and represents that: He or she shall not do anything or cause any third party to do anything which would rig or in any way influence the outcome of the giveaway with the intent to deceive the viewing public, including, but not limited to, tampering with any voting system or process. Participant agrees that Participant will not participate in any such act or any other deceptive act with respect to the Giveaway, nor permit anyone to do so in Participant's behalf. Participant agrees that if anyone tries to induce Participant to do any such act, Participant shall immediately notify the Administrator.
4. Winners:
Winners will be chosen at random and selected each week until the end of Giveaway timeframe; the winning fan will be randomly selected from the #hashtag Retweet, Regram or RePost on Twitter, Instagram or Facebook and announced on social media and Photofantasm.com. The winner will be selected each Sunday (7/5/15, 7/12/15, 7/19/15, 7/26/15) until July 31st 2015 at 12:00pm EST which will be on a Friday for a total of Five Winners. (A new image/hashtag will be posted each Monday until giveaway ends.) It is the winner's responsibility to check the website Photofantasm.com to see if they have won. The winners will be contacted via the email address or social media account they used to enter the giveaway. The list of winners will be on Photofantasm.com website.
5. Promotion Giveaway:
The winners will each receive one copy of Photofantasm Soundgarden: Nudedragons To King Animal retail value of $99.95. It is the winner's sole responsibility to redeem the prize. All potential winners are subject to verification at Spoondog Entertainment Group, LLC sole discretion. No assignment, transfer or substitution of any prize is permitted. Limit one prize per person per Giveaway.
6. General Conditions:
Spoondog Entertainment Group,LLC reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway; to be acting in violation of these Official Rules; to be acting in an unethical or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
Any use of robotic, automatic, macro, programmed or like entry methods will void all such entries by such methods, and persons using any such methods will be disqualified.
If for any reason this Giveaway is not capable of being conducted as planned due to tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Spoondog Entertainment Group,LLC , corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, Spoondog Entertainment Group,LLC reserves the right to cancel, terminate, modify or suspend the Giveaway. If the Giveaway is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted on Spoondog Entertainment Group,LLC website at Photofantasm.com
ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPOONDOG ENTERTAINMENT GROUP LLC RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM THOSE RESPONSIBLE TO THE FULLEST EXTENT PERMITTED BY LAW.

SPOONDOG ENTERTAINMENT GROUP LLC IS NOT RESPONSIBLE FOR LATE, LOST, ILLEGIBLE, MISDIRECTED ENTRIES, AND SPOONDOG ENTERTAINMENT GROUP LLC DOES NOT ASSUME RESPONSIBILITY FOR ANY ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMMUNICATIONS LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO ITS WEBSITES OR SOCIAL MEDIA. SPOONDOG ENTERTAINMENT GROUP LLC IS NOT RESPONSIBLE FOR ANY PROBLEMS OR TECHNICAL MALFUNCTION OF ANY TELEPHONE NETWORK OR TELEPHONE LINES, COMPUTER ON-LINE SYSTEMS, SERVERS, COMPUTER EQUIPMENT, SOFTWARE, FAILURE OF ANY E-MAIL OR ENTRY TO BE RECEIVED BY SPOONDOG ENTERTAINMENT GROUP LLC ON ACCOUNT OF TECHNICAL PROBLEMS, HUMAN ERROR OR TRAFFIC CONGESTION ON THE INTERNET OR AT ANY WEBSITE, OR ANY COMBINATION THEREOF. 8. ARBITRATION AND DISPUTES:
As a condition of participating in this Giveaway, you agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Giveaway, or any prizes awarded, or the determination of the Winner shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, and you further waive all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or your rights and obligations, Spoondog Entertainment Group,LLC rights and obligations in connection with this Giveaway, shall be governed by, and construed in accordance with, the laws of Michigan State, U.S.A., without giving effect to the conflict of laws rules thereof, and you agree to the jurisdiction and venue of the federal, state and local courts for Michigan for any disputes relating to the Giveaway or these Official Rules. In the event of a dispute as to the identity of any winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e- mail addresses for the domain associated with the submitted e-mail address.
